Arbitration is a way to address disputes outside of the court system. A person called an arbitrator listens to each side and decides how to resolve the dispute. If you have an issue with your mortgage loan, some protections that are generally available to you in court, like the right to appeal, may not be available in arbitration. In the past, mortgage lenders would sometimes include “mandatory arbitration clauses” in mortgage agreements. These clauses made you agree to resolve certain types of disputes in arbitration rather than in court. Mortgage lenders are no longer allowed to include “mandatory arbitration clauses” in mortgage agreements. You can’t be required to accept mandatory arbitration. You can agree to resolve an issue through arbitration if you think that’s a better way of resolving the dispute.
